Cops beat man to death as he begs for life, then confiscate witnesses' cell phones

CNN reports that Salina Quair, 34, called 911 on May 7 to report the in-progress beating to death of a man by other policemen. The “incident” occurred in Bakersfield, Calif.

After visiting a relative, Salina Quair was leaving the Kern Medical Center. As she hit the street, she saw a beating in progress, and called 911:

“There’s a man laying on the floor, and your police officers beat the sh*t out of him and killed him,” said Quair, according to a tape of the 911 call obtained KERO-TV.

“I’m right here on the corner of Flower and Palm right now and you have one, two, three, four, five, six, seven, eight sheriffs. The guy was laying on the floor, and eight sheriffs ran up and started beating him up with sticks. The man is dead laying right here, right now,” she continued.

The sheriff’s office has identified the seven deputies, including a sergeant, but the California Highway Patrol has yet to name the two patrolmen who were on the scene.

The Kern County Sheriff’s Office has said it will have no comment until the investigation is complete. However, a news release issued by the sheriff's offices indicates that the incident began May 7 just before midnight, and proceeded as follows:

A deputy sheriff responded to a call that a man, later identified as David Sal Silva -- 33, and father of four -- was lying prostrate on the ground and was probably drunk.

Silva was “uncooperative,” according to the sheriff’s office, even after a canine was deployed. (No word in the report as to why a police dog was needed to help in a public drunkenness investigation.)

“The suspect continued to actively resist the deputy and the K-9. Additional deputies arrived on scene, along with two CHP officers who responded to assist. The suspect continued to resist and received baton strikes from the deputies attempting to take him into custody,” according to the sheriff’s news release.

After Silva was finally restrained, the police requested medical assistance for his injuries, the release said. He was having trouble breathing and was taken across the street to the hospital.

“While being treated at KMC, the suspect was pronounced dead at about 12:44 a.m.,” the news release concluded.

According to KERO, several witnesses, including Quair, described an entirely different sequence of events. They said that Silva was crying, begging for help and pleading with the officers to spare his life. They ignored his pleas and continued to beat him mercilessly -- until he fell silent.

Others claim to have recorded the whole thing on their cell phones. After the beating, the officers unceremoniously snatched those phones from them. Two of those witnesses have hired attorneys to get their phones back.

There is a surviving video of the incident, however. The beating was recorded by a security camera across the street, but its quality is poor. Still, one can detect two men scuffling for about two minutes before another man arrives. The two men appear to repeatedly hit the third man while he is on his knees and later as he is lying flat on the ground.

More police cars screech into the scene. Officers gather around the man on the ground, but their actions are obscured.

As stated, the video is grainy, and the blur of light and shadow makes it virtually impossible to see what is happening.

Witnesses told CNN they were awakened by the noise. One, who asked not to be identified, described a scene not dissimilar to the Rodney King beating of the early '90s:

“He was asking for help. He was screaming with pain. He only got to ask for help like three times,” he said. “Those hits were brutal.”

Sheriff Donnie Youngblood has vowed to get to the bottom of the matter:

“I’m waiting till this investigation is done so I can look at it objectively and decide whether we did something wrong, and if we did, I’ll stand up and tell you that we did. If we didn’t, I’ll stand up and tell you that we didn’t,” he told KERO.

The Bakersfield Police Department and the Kern County Sheriff's Office are known for use of “excessive force.” Just last November, the family of Jose Lucero, 33, won a $4.5 million civil judgment against the Kern County Sheriff’s Office, according to The Bakersfield Californian. The mentally ill Lucero had made delusional 911 calls from his home. Four sheriff's deputies beat, pepper-sprayed and tasered him, killing him in front of his parents, according to newspaper reports about the 2010 incident.

Opinion

This is a case of calling the police (911) on the police.

This is a case of the police making sure to cover their tracks by confiscating cell phones from witnesses.

Silva's picture (and surname) depict him as a possible “Hispanic.” So, this may also be a case of police “profiling” of a “non-white” “drunk and disorderly” person.

As most black people understand only too well, the simple condition of blackness is enough for far too many police officers to place you under suspicion. Any “false” move can cost you your life.

And, of course, this is a case of the police investigating themselves.

My prediction is that the death of Mr. Silva will result in no serious sanctions against the officers involved in killing him. (In Chicago, they would be promoted.)

The city of Bakersfield may eventually be forced to fork over a few dollars to Silva's family, but these particular cops will go on with their “careers” as though nothing special or out of the ordinary happened that morning.

President Goodluck Jonathan Declares State Of Emergency In Borno, Yobe And Adamawa

During a nationwide broadcast this evening 14th of May 2013, President Goodluck Jonathan declared a state of  emergency in three Nigerian states of Adamawa, Yobe and Borno.
In imposing the state of emergency today, President Jonathan wielded extra-Ordinary measures by invoking Section 305, Sub section 1 of the 1999 constitution of Nigeria.  With this declaration, the president has given the military the authority to take over the  the security of the states, though all the governors in the three states will remain  in office.
The president had earlier met with the governors in the Aso Rock Villa late afternoon shortly before the the broadcast.

ADDRESS BY PRESIDENT GOODLUCK EBELE JONATHAN, GCFR ON THE DECLARATION OF A STATE OF EMERGENCY IN BORNO, YOBE AND ADAMAWA STATES IN ORDER TO RESTORE PUBLIC ORDER, PUBLIC SAFETY AND SECURITY IN THE AFFECTED STATES OF THE FEDERATION

Dear compatriots,
1.    It has become necessary for me to address you on the recent spate of terrorist activities and protracted security challenges in some parts of the country, particularly in Borno, Yobe, Adamawa, Gombe, Bauchi, Kano, Plateau and most recently Bayelsa, Taraba, Benue and Nasarawa states.  These unfortunate events have led to needless loss of lives and property of many innocent Nigerians including members of our security forces.

2.   The recent killing of security operatives by a cult group in Nasarawa state is particularly condemnable. I have directed that no effort or expense be spared in identifying and bringing to justice all those who had a hand in the killing of the operatives.

3.   The activities of insurgents and terrorists have been reprehensible, causing fear among our citizens and a near-breakdown of law and order in parts of the country, especially the North. We have taken robust steps to unravel and address the root causes of these crises, but it would appear that there is a systematic effort by insurgents and terrorists to destabilize the Nigerian state and test our collective resolve.

4.  Since I returned to the country after cutting short my visit to South Africa and aborting a planned state visit to Namibia, I have received detailed briefings from our security agencies. These briefings indicate that what we are facing is not just militancy or criminality, but a rebellion and insurgency by terrorist groups which pose a very serious threat to national unity and territorial integrity. Already, some northern parts of Borno state have been taken over by groups whose allegiance is to different flags and ideologies.

5.   These terrorists and insurgents seem determined to establish control and authority over parts of our beloved nation and to progressively overwhelm the rest of the country. In many places, they have destroyed the Nigerian flag and other symbols of state authority and in their place, hoisted strange flags suggesting the exercise of alternative sovereignty.

6.  They have attacked government buildings and facilities. They have murdered innocent citizens and state officials. They have set houses ablaze, and taken women and children as hostages. These actions amount to a declaration of war and a deliberate attempt to undermine the authority of the Nigerian state and threaten her territorial integrity. As a responsible government, we will not tolerate this.

 7.  Previously, we adopted a multi-track approach to the resolution of this problem through actions which included persuasion, dialogue and widespread consultation with the political, religious and community leaders in the affected states.

8.  We exercised restraint to allow for all efforts by both State Governors and well-meaning Nigerians to stop the repeated cases of mindless violence.

9.  Yet, the insurgents and terrorists seek to prevent government from fulfilling its constitutional obligations to the people as they pursue their fanatical agenda of mayhem, mass murder, division and separatism.

10. While the efforts at persuasion and dialogue will continue, let me reiterate that we have a sacred duty to ensure the security and well-being of all our people and protect the sovereign integrity of our country. Therefore, we shall, on no account, shy away from doing whatever becomes necessary to provide the fullest possible security for the citizens of this country in any part of the country they choose to reside.

11.   We have a duty to stand firm against those who threaten the sovereign integrity of the Nigerian state. Our will is strong, because our faith lies in the indivisibility of Nigeria.

12.  Following recent developments in the affected states, it has become necessary for Government to take extraordinary measures to restore normalcy. After wide consultations, and in exercise of the powers conferred on me by the provisions of Section 305, sub-section 1 of the Constitution of the Federal Republic of Nigeria 1999 as amended, I hereby declare a State of Emergency in Borno, Yobe and Adamawa states.

13.  Accordingly, the Chief of Defence Staff has been directed to immediately deploy more troops to these states for more effective internal security operations. The troops and other security agencies involved in these operations have orders to take all necessary action, within the ambit of their rules of engagement, to put an end to the impunity of insurgents and terrorists.

14.  This will include the authority to arrest and detain suspects, the taking of possession and control of any building or structure used for terrorist purposes, the lock-down of any area of terrorist operation, the conduct of searches, and the apprehension of persons in illegal possession of weapons.


15.  The details of this Proclamation will be transmitted to the National Assembly in accordance with the provisions of the Constitution. But in the meantime, let me make it clear that within the purview of this Proclamation, the Governors and other political office holders in the affected states will continue to discharge their constitutional responsibilities.

16.   I urge the political leadership in Borno, Yobe and Adamawa states to co-operate maximally with the Armed Forces and the Police to ensure that the exercise succeeds. We call on the citizenry to co-operate with our security agencies to ensure a return to normalcy within the shortest possible time.

17.   I am again approaching our neighbouring countries, through diplomatic channels, as done in the recent past, for their co-operation in apprehending any terrorist elements that may escape across the border.


18.  Nigerians are peace-loving people; these sad events perpetrated by those who do not wish our nation well have not changed the essential character of our people.


19.  I want to reassure you all that those who are directly or indirectly encouraging any form of rebellion against the Nigerian state, and their collaborators; those insurgents and terrorists who take delight in killing our security operatives, whoever they may be, wherever they may go, we will hunt them down, we will fish them out, and we will bring them to justice. No matter what it takes, we will win this war against terror.

20.  I am convinced that with your support and prayers, we shall overcome these challenges and together, we will restore every part of our country to the path of peace, growth and development.

CAN’s Borno secretary killed minutes after Pres Jonathan's broadcast

Just minutes after President Jonathan declared a State of Emergency in Borno State (and two other states), the Secretary of the Christian Association of Nigeria (CAN) in the state, Reverend Faye Pama Musa was killed by suspected Boko Haram members. This happened around 7.30pm this evening.

Reverend Pama Musa, who was the head pastor of a pentecostal church in Maiduguri, was shot dead inside his GRA home by two gunmen who trailed him to his residence. The head quarters of Borno CAN have confirmed his killing.

Asa Survives a Car Accident in Nashville, Tennessee USA

78 Year Old Woman Declared Missing Found Dead In Son’s Ritual Cupboard

The police in Imo have arrested one Chimezie Osuigwe, a retired vice-principal, for the alleged murder of his 78-year-old mother in 2003.
Osuigwe, a 64-year old was arrested after the embalmed body of the septuagenarian was discovered in a cupboard at his house by a family member.
According to Mr Musa Katsina, the Commissioner of Police in Imo, the woman, Mrs Lucy Osuigwe, was declared missing since 2003.
Katsina told newsmen at the house in Ejemekuru in Oguta Local Government Area on Monday that the embalmed body had been kept in that condition since 2003.

“The corpse of Mrs Lucy Osuigwe, who was declared missing in 2003 was found in a large cupboard inside a shrine in a private room in a circumstance depicting ritual practice.
“The embalmed body, which was kept in that condition for about 10 years is believed to have been placed in the wardrobe by her son, Dr Chimezie Osuigwe, a devotee of the Guru Maharaji Sect.
“Preliminary assessment of the scene of crime revealed that the woman must have been murdered by the son for ritual purposes,” he said.
The commissioner said that plans were on to arrest other members of the sect who visit Osuigwe’s shrine.
He said the body would be handed over to the forensic team of the command to determine the cause of death.
He also said the suspect would be held for first degree murder until the cause of death was established.

Court Dissolves Pastor's Marriage Over Adultery Issues

 

"Starting from today, you seize to be addressed as husband and wife.You shall go your separate ways unmolested. “The pastor shall pay the sum of N30,000 to the wife to enable her start a business to keep body and soul together." 

With the above ruling, Joseph Adewusi, president of Orile-Agege Customary Court in Lagos on Monday dissolved the four-year-old marriage of Pastor Segun Fasina and his wife, Abosede.

The petitioner, Pastor Fasina, had filed the suit on March 12, seeking dissolution of their young marriage over his wife’s allegedly infidelity. A resident of No.4 Moses Street, Alagba, Orile-Agege, Pastor Fasina told the court that Abosede had lost her sense of dignity and was now smoking and consuming alcohol.

The pastor also said that his wife was troublesome and a gossip. “My wife, Abosede, possesses all the bad habits one can think of. She was accused of stealing a phone in our house. I believed she actually stole it because of her behaviour. She goes to other co-tenants’ apartments to gossip.

“And whenever there is any fight in the house, my wife’s name is always mentioned. As a pastor, I have prayed for her deliverance from the evil acts but my effort was in vain. Since the marriage is childless, we owe ourselves nothing. So, I want the court to dissolve the union.”

But Abosede, 30, denied the allegations. She said, “My husband is adulterous. He counsels his church members at home, and I discovered that most of them are ladies. He was inside the room counselling a woman when I dashed in. But to my surprise, my husband and the woman were both naked in our bed.

“My husband beat me and threw me out of the house. When I reported the case to his father, the man said, I should not disturb his son. I am not a drunk. My husband saw me with alcohol that was meant to cleanse my stomach, so that I can get pregnant,” she said.

While dissolving their marriage, the magistrate said the marriage had broken up irreparably.

Fulani herdsmen kill over 50 mourners in Agatu, Benue state

Over 50 mourners were killed yesterday Sunday May 12th in Benue State by Fulani herdsmen who attacked them as they buried their dead. The herdsmen stormed Okpachanyi village in Agatu local government area of the state and opened fire on the mourners, killing at least 50 of them. Others escaped with serious injuries.

The mourners had gathered to bury two of the policemen killed last week Tuesday by Ombatse cult members in Nassarawa state. Anarchy in our land!
